NOTICE TO OWNER

FAILURE OF THIS CONTRACTOR TO PAY THOSE PERSONS SUPPLYING MATERIAL OR SERVICES TO COMPLETE
THIS CONTRACT CAN RESULT IN THE FILING OF A MECHANIC'S LIEN ON THE PROPERTY WHICH IS THE SUBJECT
OF THIS CONTRACT PURSUANT TO CHAPTER 429, RSMO. TO AVOID THIS RESULT YOU MAY ASK THIS
CONTRACTOR FOR "LIEN WAIVERS" FROM ALL PERSONS SUPPLYING MATERIAL OR SERVICES FOR THE WORK
DESCRIBED IN THIS CONTRACT. FAILURE TO SECURE LIEN WAIVERS MAY RESULT IN YOUR PAYING FOR LABOR
AND MATERIAL TWICE.

IN THE EVENT THIS ACCOUNT IS SUBMITTED FOR COLLECTION CUSTOMER AGREES TO PAY REASONABLE
ATTORNEY FEES AND COURT COSTS.

TERMS AND CONDITIONS
	If this contract includes installation, it is a construction contract. As part of this construction contract, a service
	charge or surcharge may be included which represents a portion of the expenses and/or taxes incurred by
	contractor in fulfillment of this construction contract. At the owner's request this contract may be itemized.
	Whether itemized or not, this construction contract is an agreement between the contractor and owner to improve,
	repair, replace, erect or alter real property.

	Carpet One Floor & Home disclaims liability for incidental or consequential damages resulting from the use of or any
	defects in the goods, delay of performance, or otherwise arising out of the sale or installation of the goods.

	If buyer notifies Carpet One Floor & Home in writing within three days after the date of this order by Buyer's decision
	not to accept delivery of the above goods before delivery of the goods by Carpet One Floor & Home to Buyer, then this
	order shall be cancelled. However, if the Buyer has made a deposit to ensure earlier ordering from the
	manufacturer, the deposit shall be fully earned and NON-refundable. If cancellation by Buyer is made after three
	days from the date of this order, Buyer shall pay Carpet One Floor & Home a restocking fee of 25% of the total
	purchase price. NO RETURNS ON SPECIAL ORDERS.

	The remedies for default by Carpet One Floor & Home contained in this order are exclusive and in lieu of any other
	remedy that might otherwise be available to Buyer.

	Buyer acknowledges that at the time of signing this order, Buyer received a fully completed copy of the order
	plus a copy of all documents signed by Buyer in connection with this order.

	The terms of this order may not be amended except in writing signed by Carpet One Floor & Home. The
	requirements of this paragraph may only be waived in writing by Carpet One Floor & Home.

	This order constitutes the entire agreement of Buyer and Carpet One Floor & Home, and all other statements,
	either written or oral, of Buyer and Carpet One Floor & Home are merged in this order.

	FINANCE CHARGE is computed by Monthly Rate of 1 1/2% which is an Annual Percentage Rate of 18%
	applied to the previous balance before the next billing date. To avoid FINANCE CHARGES balance must be
	paid in full within 30 days of installation.

	If the provisions of this paragraph are initialed by one or more of the Buyer(s), Buyer(s) agree that the goods
	were selected be Buyer contrary to the advice of Carpet One Floor & Home or contrary to manufacturer's specification,
	and therefore Carpet One Floor & Home shall have no obligation or liability to Buyer on account of any failure of the
	goods to meet manufacturer's specification, and therefore any defects in the goods, any defects in the installation
	of the goods, any defects in services rendered by Carpet One Floor & Home with respect to the installation of the goods
	by Carpet One Floor & Home.

	Buyer agrees that title to and ownership of the above described property passes from Carpet One Floor & Home to the
	Buyer upon permanent and complete installation. Risk of loss or damage to the property sold, whether from fire
	or other causes, occurring after delivery to the Buyer is assumed by the Buyer, and no such damage shall
	affect the rights of Carpet One Floor & Home.

	All material is guaranteed to be as specified. All work is to be completed in a workmanlike manner according to
	standard practices. Any alteration or deviation from above specifications involving extra cost will be executed only
	upon written orders, and will become an extra charge over and above the contract amount. All agreements
	contingent upon strikes or accidents of delays beyond our control. Owner is to carry fire, tornado, and other
	necessary insurance. Our workers are fully covered by Worker's Compensation insurance.

	Carpet One Floor & Home is not responsible for cutting doors.
